Holder and general terms and conditions
The present General Terms and Conditions – hereinafter GTC -, regulate the conditions of purchase of the different products offered on our website: www.quickauto24.com, owned by Tadevosyan, Aharon with NIF X6215048B, and located in Lagar El Tomillar 1, 41590, La Roda de Andalucía, Sevilla – Spain.
Users who make purchases at www. quickauto24.com fully accept these GTC and will be bound by these, as if they were written at the time of recruitment / purchase.
It will be an indispensable requirement the reading and acceptance of the GTC, prior to the purchase of any product through www.quickauto24.com.
Tadevosyan, Aharon reserves the right to modify the GTC at any time and without prior notice. The GTC will always be accessible from the website, so that the user can consult or print them at any time.
The prices and conditions of sale are for information purposes only and may be modified according to market fluctuations. However, the completion of the order by filling out the purchase form, implies conformity with the price offered and the general conditions of sale in force at that particular time. Once the order has been formalized, the purchase will be understood to be perfected by right, with all the legal guarantees that protect the purchasing consumer and, from that moment, the prices and conditions will have contractual character and cannot be modified without the express agreement of both contracting parties. Spanish will be the language used to formalize the contract. The electronic document in which the contract is formalized will be filed and the user will have access to it in his customer area.
It reserves the right to deny and/or suspend access to the services provided in www.quickauto24.com for reasons of breach of contractual good faith, breach of applicable law, of these General Conditions of Purchase and / or in cases of fraud detected by this company and / or any of its suppliers.
Shipping
The delivery time is 24 hours. We cannot guarantee these delivery times, although we try to ensure that transport companies meet them whenever possible.
In orders that include several items, a single shipment will be made and the delivery time will correspond to the item with the longest delivery time.
The customer will have 5 days to check the integrity of all the components of the order and to verify that everything is included in the products included. After these 5 days the shipment will be considered accepted and no claims will be accepted for damage or faults with the shipment.
An order will be considered delivered when the delivery receipt is signed by the customer. It is in the next 5 days when the customer must verify the products upon receipt of the same and expose all the objections that may exist.
In case of receiving a product damaged by transport it is advisable to contact us within the first 24 hours to be able to claim the incident to the transport company. In the same way it is convenient to leave a record to the transport company.
Cancellation
For these purposes, we inform that the Revised Text of the General Law for the Defense of Consumers and Users provides several options to exercise the right of withdrawal. Among them is the possibility of doing so by filling out a form electronically. In order to shorten the time and that you can make the return in a comfortable way and without delay, we advise you to make use of this option and fill out the withdrawal form.
In accordance with current legislation, you can proceed to cancel the contract concluded, without the need to justify such decision and without penalty of any kind, within 14 calendar days of receipt of the goods by the customer. To do so, the conditions set out in this document must be complied with: withdrawal form.
The consumer will only be liable for the decrease in value of the goods resulting from a manipulation of them other than that necessary to establish their nature, their characteristics or their functioning.
The right of withdrawal shall not apply to contracts relating to:
The provision of services, once the service has been fully performed, and if the contract imposes on the consumer or user an obligation to pay, when performance has begun, with prior express consent of the consumer or user and with the knowledge on his part that, once the entrepreneur has fully performed the contract, he will have lost his right of withdrawal.
The supply of goods or the provision of services whose price depends on fluctuations in the financial market that the entrepreneur cannot control and that may occur during the withdrawal period.
The supply of goods made to the specifications of the consumer and user or clearly personalized.
The supply of goods that may deteriorate or expire rapidly.
The supply of sealed goods that are not suitable for return for reasons of health protection or hygiene and have been unsealed after delivery.
The supply of goods which after delivery and taking into account their nature have been inseparably mixed with other goods.
The supply of alcoholic beverages whose price has been agreed at the time of concluding the sales contract and which cannot be delivered within 30 days, and whose actual value depends on market fluctuations beyond the entrepreneur’s control.
Contracts in which the consumer and user has specifically requested the trader to visit him for urgent repair or maintenance operations; if, during such visit, the trader provides additional services to those specifically requested by the consumer or supplies goods other than the spare parts necessarily used to carry out the maintenance or repair operations, the right of withdrawal should apply to such additional services or goods.
Contracts concluded by means of public auctions.
The supply of accommodation services for purposes other than the provision of housing, transportation of goods, car rental, food or services related to leisure activities, if the contracts provide for a specific date or period of performance.
The supply of digital content that is not provided on a tangible medium when performance has begun and, if the contract imposes on the consumer or user an obligation to pay, when the following conditions are met:
The consumer or user has given his prior consent to commence performance during the period of the right of withdrawal.
The consumer or user has expressed his knowledge that he consequently loses his right of withdrawal; and.
The entrepreneur has provided a confirmation in accordance with Article 98.7 or Article 99.2.
Once we receive the product(s), we will refund you according to the payment method you used:
If you paid by card, we will credit your account within 48 to 72 hours.
If you paid by Paypal, we will credit your Paypal account.
If you paid by wire transfer, we will ask you for an account number to credit your account. Please note that it can take up to 48 working hours before it is reflected in your bank account.
For the rest of the payment methods, we will ask you for an account number to make the payment. You will only be responsible for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish their nature, characteristics or functioning
Return conditions for distributors
You can return your items for any reason in new (intact or unsealed) or used condition, and without return costs, beyond the legally established period to exercise the right of withdrawal (14 calendar days from delivery) until the next 30 calendar days from your purchase. Service available only on new, reconditioned or used products.
In order to avoid any kind of damage in the shipment, all merchandise must be returned in its original condition, in perfect condition and protected, avoiding stickers, seals or adhesive tapes directly on the surface or packaging of the item.
Once the return request has been filled in and sent, you will receive the instructions to send it to our facilities in your email. You must send the goods without any delay and always within a maximum period of 30 calendar days from the date you received your order.
Once we have received the goods and checked that they are in perfect condition, we will process the refund. We will refund the payment received, including the cost of delivery with the exception of the additional costs resulting from your choice of a delivery method other than the least expensive ordinary delivery method that we offer.
Warranties
The warranty does not cover defects caused by improper use of the product and/or handling of the product other than what is necessary to establish its nature, characteristics or operation. In such cases, the consumer shall be responsible for its repair. They are, therefore, excluded from the warranty:
Defects and deterioration caused by external events, accidents, mainly electrical accidents or wear and tear.
Products modified or repaired by the customer or any other person, as well as products that are the subject of a specific support contract.
Incorrect software/hardware configuration, by the customer, of equipment, components or peripherals.
Order cancellations
Those order cancellations that involve a refund to the customer and that are by bank transfer will have a maximum period of 30 days for administrative procedures, although we try that the period does not exceed 7 days.
